These Terms & Conditions ("Terms") govern your use of DupScan("the App"), developed by Marcel Iseli ("we", "us", or "our"). By downloading, installing, or using DupScan, you agree to these Terms. If you do not agree, do not use the App.
License
We grant you a limited, non-exclusive, non-transferable, revocable license to use DupScan on any Mac that you own or control, subject to these Terms and the Mac App Store terms of service. This license does not allow you to distribute, sublicense, reverse-engineer, decompile, or disassemble the App.
Free and Pro Versions
DupScan is available as a free download with limited functionality. The free version provides unlimited scanning, full duplicate detection, large file discovery, filtering, sorting, and Reveal in Finder functionality. The free version does not permit file deletion or restoration.
The Pro upgrade is available as a one-time in-app purchase. Pro unlocks file deletion (moving files to Trash), large file deletion, and file restoration from History. The Pro upgrade is a one-time payment with no subscription, recurring charges, or expiration.
All in-app purchase transactions are processed by Apple through the Mac App Store and are subject to Apple's terms and refund policies.
File Deletion and Data Loss
DupScan moves files to macOS Trash when you choose to delete them. Files in Trash can be recovered until you or macOS empties the Trash. Once the Trash is emptied, deleted files cannot be recovered through DupScan or any other means.
While DupScan implements safety measures including protected system paths, protected app bundles, and confirmation dialogs, you are solely responsible for reviewing and confirming file selections before deletion. We recommend maintaining regular backups of important data using Time Machine or another backup solution.
You acknowledge that file deletion carries inherent risk and that we are not liable for any data loss resulting from your use of the App, whether through the free or Pro version.
Protected Paths
DupScan automatically protects system-critical directories (/System, /Library, /usr, /bin, /sbin, /private, ~/Library) and files inside application bundles (.app). Protected files cannot be selected for deletion. This protection is a safety feature and does not constitute a guarantee against all possible data loss scenarios.
System Requirements
DupScan requires macOS 13.0 (Ventura) or later. The App runs natively on Apple Silicon and Intel Macs. The App requires file access permissions granted through standard macOS permission dialogs in order to scan files and folders.
Intellectual Property
DupScan, including its name, logo, user interface, and source code, is the intellectual property of Marcel Iseli. All rights not expressly granted in these Terms are reserved. You may not copy, modify, or create derivative works based on the App.
Disclaimer of Warranties
DupScanis provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of harmful components.
While DupScan uses SHA256 cryptographic hashing for duplicate detection, which provides an extremely high degree of accuracy, we do not guarantee that the App will identify all duplicate files or that all identified duplicates are safe to delete in every circumstance.
Limitation of Liability
To the maximum extent permitted by applicable law, Marcel Iseli shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, or loss of business opportunities, arising out of or related to your use of DupScan, regardless of the cause of action or the theory of liability.
Our total liability for any claim arising from or related to the App shall not exceed the amount you paid for the App (including the Pro upgrade).
Termination
We reserve the right to terminate or suspend your license to use DupScan at any time for violation of these Terms. Upon termination, you must cease all use of the App and delete all copies from your devices.
Governing Law
These Terms are governed by and construed in accordance with the laws of Switzerland, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved in the courts of Switzerland.
Changes to These Terms
We may update these Terms from time to time. Any changes will be posted on this page with an updated effective date. Continued use of the App after changes constitutes acceptance of the revised Terms.
